34/2023-DGFT Dated: 13th October 2023

In a bid to foster ease of doing business and reduce transaction costs, the Directorate General of Foreign Trade, under the Ministry of Commerce & Industry, Government of India, has introduced important amendments to Para 4.10 (i) of the Handbook of Procedures 2023. This amendment specifically pertains to the Input Tax Credit (ITC) on materials for the Advance Authorization Scheme.

The key change is in relation to the transfer of duty-free materials imported or procured under the Advance Authorization Scheme from one unit of a company to another unit for manufacturing purposes. The Handbook previously allowed such transfers with prior intimation to the jurisdictional Customs Authority but explicitly stated that no Input Tax Credit (ITC) would be claimable on these transferred inputs. With the new amendment, there’s a fundamental shift. In cases where duty-free imported or indigenously procured materials, on which Goods and Services Tax (GST) has been paid, are transferred between units located in the same or different states, the availability of Input Tax Credit (ITC) shall be subject to the provisions of the GST law and its associated rules.

DGFT Policy Circular No. 06/2023-24 on October 19, 2023 : The Ministry of Commerce & Industry’s Directorate General of Foreign Trade (DGFT) has released Policy Circular No. 06/2023-24 on October 19, 2023, addressing the implementation of Import Management Systems for IT Hardware. This circular provides important clarifications following DGFT Notification No. 23/2023 dated 03rd August 2023, Notification No. 26/2023 dated 4th August 2023, and No. 38/2023 dated October 19, 2023, which restricted the import of specific IT hardware.

Policy Circular No. 06/2023-24 plays a pivotal role in providing much-needed clarity to participants in the trade and industry sectors. It serves as a comprehensive guide for the effective implementation of the Import Management Systems concerning IT Hardware. The objective of this circular is to facilitate a streamlined process for SEZ units, EOUs, and other entities engaged in imports, allowing them to navigate import restrictions with ease. Furthermore, this circular introduces flexibility by accommodating amendments and exemptions related to IT hardware imports, thus fostering a more dynamic and adaptable framework for industry stakeholders.

38/2023- DGFT on October 19, 2023 : The Ministry of Commerce and Industry, under the Directorate General of Foreign Trade (DGFT), has issued Notification No. 38/2023- DGFT on October 19, 2023. This notification introduces amendments to Policy Condition no. 4 of Chapter 84 of Schedule 1, which pertains to the import policy for IT hardware under the Indian Trade Classification (HS), 2022.

This notification marks a substantial shift in the import policy governing IT hardware. It simplifies the process by allowing IT hardware manufactured within Special Economic Zones (SEZ) to be imported into the Domestic Tariff Area (DTA) without the need for an Import Authorization. Furthermore, it extends exemptions to private entities that import IT hardware for Defense or Security purposes on behalf of Central and State Government entities, eliminating the requirement for an import authorization. This amendment also introduces flexibility by accommodating the import of IT hardware for repair, return, replacement, and re-importation of repaired items. This notification underlines the government's commitment to streamlining the import procedures for IT hardware and its dedication to supporting government security initiatives.

Indian telecom industry’s talent demand-supply gap at 2.41 million, to jump 3.8 times by 2030

India has emerged as the fastest nation to rollout 5G network in the world, but at the same time the telecom industry is facing severe talent crunch. Currently, the telecom demand-supply gap is at 2.41 million, which is expected to jump to 3.8 times by 2030, says a report released by Telecom Sector Skill Council (TSSC). The report, ‘Telecom Talent in 5G Era: Demand Supply Skill Gap Report 2023-24’ by TSSC, India’s premier skill development institution for the telecom sector, in association with Draup, says a key challenge lies in the fact that only 40% of India’s graduates in computer science, IT, and math are employable in the technology sector due to the mismatch between academic requirements and industry demands.

The new made-in-India EV charging standard for bikes and scooters: here’s why it matters

The Bureau of Indian Standards (BIS) has approved an indigenously developed AC and DC combined charging connector standard for light electric vehicles (LEVs) such as scooters, bikes, and rickshaws. Electric vehicle (EV) charging connector standards are conceptually similar to charging connector standards for mobile phones, such as the USB Type-C charger or Apple’s lightning charger. The new standard, ISI7017 (Part 2 / Sec 7): 2023, cleared by BIS last week, has been developed through collaboration among NITI Aayog, the Department of Science and Technology, electric two-wheeler maker Ather Energy, and various other government and industry stakeholders.

More alarm bells sound on slowing demand for electric vehicles

High interest rates are derailing the ambitions of climate regulators and automakers to accelerate the shift to electric vehicles, underscored Wednesday by the scrapping of a GM-Honda partnership and a warning from a battery maker. Electric vehicle sales are still growing strongly, but that demand is not keeping up with the expectations of carmakers and other companies that have invested billions of dollars in the EV space. Expectations for persistently higher interest rates has led companies to alter plans as they eye 2024 warily. EV demand next year could be lower than expectations," Lee Chang-sil, chief financial officer at South Korean battery maker LG Energy Solution said on Wednesday, due to global economic uncertainty.

Ford will postpone about $12 billion in EV investment as buyers become more cautious

Ford Motor said Thursday that many customers in North America are no longer willing to pay a premium for an electric vehicle over an internal-combustion or hybrid alternative. As a result, it’s postponing about $12 billion in planned spending on new EV manufacturing capacity. Customers’ reluctance to pay extra for EVs has complicated Ford’s ambitious and expensive plans to sharply increase production of those vehicles. While Ford’s – and the industry’s – sales of EVs are growing, they aren’t growing at the pace Ford had expected. Ford executives emphasized that the company isn’t cutting back its spending on future electric vehicle models. But it now plans to ramp up its EV manufacturing capacity, and its spending on that capacity, more gradually than previously planned.

Harald Wilhelm, the chief financial officer of Mercedes-Benz, said the electric car industry was “a pretty brutal space”, on an analyst call on Thursday, Reuters reported, after the German carmaker reported a fall in profits.

Further, it states that the MSME sector played a vital role in the recovery of the economies of Asia and the Pacific region. According to the report, initiatives such as “the formalization of small businesses, reskilling, and upskilling of workers, along with the integration of digital tools and technology, economic diversification, and increasing access to new and innovative financing can create a fertile environment” for these businesses to contribute to sustainable growth.
